Learned counsel for the petitioner, at the very outset, submits that due to some inadvertent error, a different order has been challenged in the present petition. He submits that the petitioner is not inclined to challenge the order dated 13.08.2024 and wants to challenge one other order passed during the proceedings of the complaint case in question. He, therefore, seeks permission to withdraw the present petition with liberty to file fresh petition challenging order dated 02.05.2024.

Copy of the abovesaid order has been attached with petition as Annexure-A.

In view of the above, without prejudice to rights and contentions of the parties, the present petition is permitted to be withdrawn, petitioner is always at liberty to file fresh petition, albeit, in accordance with law.
