This hearing has been held through video-conferencing. 2.

The Petitioner seeks interim bail in this matter. He has been accused of offences under Sections 395/397/412/120-B of the IPC and Sections 25/27/54/59 of the Arms Act, 1959. The Petitioner's application for interim bail was rejected by the Trial Court on 18th April, 2020. The primary ground on which bail is sought is that two of the co-accused against whom similar charges have been levied, have already been given bail by the Trial Court. Accordingly, due to this fact and the prevalent lockdown on account of COVID-19, bail is sought.

Ld. APP submits that the Petitioner is one of the main accused in the present case and was, in fact, the main person involved in the forceful taking away of Rs.20 lakhs. Evidence in the form of a new Royal Enfield Motorcycle and an OPPO mobile phone, purchased from the looted amount, was recovered. Ld. APP further submits that insofar as the verification of the

treatment papers of the Petitioner's father is concerned, the same have been verified. It has also been verified that the two co-accused, namely, Mr. Imran and Mr. Deepak Arora have both been given bail. Mr. Imran has been given bail of 45 days and Mr. Deepak Arora has been given bail of 10 days, which was later extended by a further 10 days vide order dated 29th May, 2020, vide orders dated 18th June, 2020 and 16th May, 2020 respectively. The orders have been perused.

Ld. counsel for the Petitioner submits that under these circumstances, the Petitioner, who has elderly parents and two minor children be also granted interim bail of 45 days.

After considering the overall facts and circumstances, including the fact that the medical reports of the Petitioner's father have been verified and the other co-accused have been given interim bail, the Petitioner is also given interim bail for a period of 45 days from the date of his release, subject to the following conditions:

i) The Petitioner shall furnish a personal bond to the tune of Rs.50,000/- along with a surety of the like amount to the satisfaction of the concerned Court;

ii) The Petitioner shall not contact or influence any of the prosecution's witnesses directly or indirectly; iii) The Petitioner shall provide his active mobile number to the IO and the IO shall remain in touch with the Applicant on a regular basis; iv) The Petitioner shall not leave Delhi and shall give his residential address, as mentioned in the memo of parties, to the IO; 6.

The Petitioner shall surrender upon the expiry of the bail period. Copy of this order be communicated to the Jail Superintendent, Jail No.13,

Mandoli Jail, Delhi for compliance.

The petition is disposed of in the above terms. All pending applications are also disposed of.
