The petitioners, who are husband and wife, have filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of proceedings arising out of FIR No. 165/2020 dated 19.10.2020, registered at Police Station Economic Offences Wing, under Sections 420/406/120B of the Indian Penal Code, 1860, in which they are accused. They assail a direction in the order dated 12.02.2026, passed by the learned Magistrate's Court, requiring them to appear physically on 29.04.2026.

I have heard Ms. Nupur Sharma, learned counsel for the petitioners, Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor, and Mr. Samudra Sarangi, learned counsel for respondent Nos. 2 to 11.

Although the petition has been filed on behalf of both the petitioners, it is pressed only on behalf of petitioner no. 1 on account of his serious medical condition.

Medical documents have been placed on record to show that petitioner No. 1 suffers from serious heart diseases, and has been on the waiting list for a heart transplant since the year 2022, in the course of which he has been advised to remain in isolation. The latest medical certificate in this regard is dated 06.03.2026, wherein he has been advised to stay in isolation at home to avoid the risk of heart failure, and in view of his compromised immunity.

Ms. Sharma has also drawn my attention to an order of the learned Sessions Court, in an unrelated case under the Prevention of Money Laundering Act, 2002 [Complaint Case No. 87/2023: ED v. Ramesh Chand Arora and Ors.], in which it was directed that bonds may be furnished on behalf of the accused, which would stand accepted on being so furnished.

Having regard to the medical documents of petitioner No. 1, I am of the view that it is appropriate to exempt him from physical appearance before the learned Magistrate's Court, subject to bonds being furnished on his behalf through his counsel, upon which his digital signature may be affixed, and the presence of petitioner No. 1 through video conference before the learned Magistrate's Court.

Mr. Chauhan and Mr. Sarangi also do not object to such a procedure, in view of the medical condition of petitioner No. 1. 8.

If any further directions are required to ease the modalities of his appearance within the statutory framework, the learned Magistrate's Court is free to pass such orders as may be required. It is made clear that petitioner no. 2 will, however, appear physically as directed. 9.

The petition, alongwith pending application, stands disposed of. 10.

A copy of the order be given dasti under the signature of the Court Master.
