The learned counsel appearing on behalf of the New Delhi Municipal Council (hereafter the NDMC) has handed over a site lay out plan which indicates that the petitioner can carry on his vending activities from the site besides Delhi Public Library, which is within one hundred meters of shop No.136, Sarojini Nagar Market, New Delhi. The said site is marked in the said layout plan.

Although, the concerned SHO has filed a status report indicating a vacant site, which is closer to shop No.136, Sarojini Nagar Market, New Delhi, however, the learned counsel for the NDMC states that the said area is already overcrowded and the petitioner cannot be permitted to vend there. The learned counsel for the petitioner/applicant is satisfied with the site as marked in the site layout plan furnished by the NDMC. The same is taken on the record.

The petitioner would not be disturbed from vending at the said site. 5.

It is clarified that the orders passed by this Court would not create any permanent rights in respect of the aforesaid site in favour of the petitioner. 6.
