The present writ petition has been filed seeking a direction to the respondent no.1/MCD to demolish the unauthorised construction raised by the private respondent no.2, in Plots No. 193-194, Pocket- H-1, Sector-I 1, Rohini, Delhi (hereinafter 'subject property'). 2.

Pursuant to the order passed by this Court on 24th April, 2026, the private respondent no.2 has placed on record the order dated 10th April, 2026, passed by the Appellate Tribunal MCD (ATMCD) in Appeal No.208/2026.

In terms of the aforesaid order, it has been directed that no coercive steps shall be taken against the property of respondent no.2 in pursuance of the demolition order dated 16th April, 2024. this order will not apply to encroachment on public land. 4.

In view thereof, the present writ petition is disposed of while directing the respondent no.1/MCD to take action based on the outcome of the act in terms of the order passed by the ATMCD and based on the outcome of the appeal.
