Applicant seeks interim bail so that he is in a position to take his examination for class-XII, being conducted by National Institute of Open Schooling (NIOS).

As per the admit card/hall ticket, the examinations are scheduled on 17.04.2026, 20.04.2026, 28.04.2026, 30.04.2026 and 05.05.2026 at Daisy Dales Sr. Sec. School.

The applicant has already missed his two initial examinations, which were scheduled on 17.04.2026 and 20.04.2026.

When the abovesaid relief was sought by moving appropriate application before the learned Court of Sessions, learned Court declined interim bail but at the same time, granted custody parole for a period of six hours excluding the journey time so that he is in a position to attend his examination in terms of the abovesaid hall-ticket. However, there was also an additional direction that such custody parole would be at his own expenses. 5.

After hearing arguments for some time, learned counsel for the applicant, without prejudice to his rights and contentions, submits that he would be at satisfied if the abovesaid condition regarding bearing of expenses BAIL APPLN. 1584/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. is waived.

Learned APP for the State leaves it to this Court to pass appropriate order in this regard.

In view of the above, the present application is disposed of with the modification in order dated 16.04.2026 to the effect that the custody parole would be at expense of the State and the applicant would not be required to incur any expense from his pocket with respect to the custody parole. 8.

The application stands disposed of in aforesaid terms. 9.

Pending application also stands disposed of.

A copy of this order be sent to Superintendent Jail for information and requisite compliance.
