Applicant seeks anticipatory bail in case arising out of FIR No.64/2025 dated 03.09.2025, for commission of offences under Sections 308/318(4)/319/340 of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 383/420/416/470 IPC), registered at P.S. Special Cell. 2.
The copy of FIR is on record which indicates that the complainant lodged a report to the police on 03.09.2025 stating therein that she was a victim of financial fraud of Rs. 2.75 crores approx. She claimed that somebody had deceived and cheated her and on such inducement, she made the abovesaid payment and, thus, prayed for necessary legal action. 3.
The applicant, initially, filed an application seeking anticipatory bail before the learned Sessions Court and his such application has been dismissed on 07.04.2026.

A comprehensive reply had been filed by the investigating agency before the learned Sessions Court, copy of which is on record. 5.
As per prosecution, the complainant came to know about a company "Shoonya" which used to assist in investment in share trading. She was, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
eventually, contacted by some fraudsters on Whatsapp, who informed her that they were from"Shoonya" and when she downloaded application, customer support added her in a Whatsapp group and started giving her tips and suggestions for investment in IPOs and Stocks. 6.
Such group was created on 03.07.2025 and she was assured about good profits also. She was forced to deposit money on the pretext that otherwise she will not be able to withdraw the profits and believing so, she transferred a sum of Rs. 2,74,61,781/- in twelve different accounts as provided by the fraudsters.

During investigation, police collected details of all such twelve accounts.

A sum of Rs. 30,00,000/- on 31.07.2025 had been transferred from account of the complainant to Bandhan Bank, which as per the investigation first layer bank. Thereafter, a sum of Rs. 20,00,000/- was transferred from Bandhan Bank into Axis Bank account of Birsangwas Solutions Private Limited. The abovesaid Axis Bank branch is of Section 86, Gurgaon and investigation revealed that there were two directors in the abovesaid company i.e. Applicant Lokesh Kumar and his sister Shweta and they both were authorized signatories.

When efforts were made to reach them, they were not traceable. 10.
The police also collected Call Detail Record (CDR) linked with the abovesaid account and with the help of the technical surveillance, the address of the applicant was traced out and he was served with the notice to join the investigation but despite service of notice, he did not come forward and did not join the investigation.

Learned counsel for applicant submits that he himself is a victim as the money was got transferred in his account and was, thereafter, transferred out from his account by his brother-in-law i.e. Ravinder @ Ravi. Ravinder @ Ravi is husband of his sister Shweta and who is also, as already noted above, a Co-director and signatory.

According to applicant, his brother-in-law had claimed that he wanted to start a business and based on his misrepresentation, the abovesaid company and the bank account were opened. He had trusted his brother-in-law and did not know that his intentions were other than bona fide. 14.
Learned APP for the State submits that when the Axis Bank was contacted, they had given a comprehensive account statements, which indicate that on the same date i.e. 31.07.2025, the abovesaid amount of Rs. 20,00,000/- was transferred out in hundreds of other accounts. 15.
The case is at a very crucial stage. The Court cannot be mindful of the enormous loss caused to the complainant by such fraudsters. 16.
At this stage, it will not be possible to assume applicant as a victim and his custodial interrogation looks imperative. 17.
Finding no merit and substance in the present application, the same stands dismissed.
