Through the present Petition, the Petitioner prays for issuance of a Writ in the nature of Certiorari to quash the order rejecting Petitioner‟s technical bid submitted pursuant to tender bearing Bid No. GEM/2025/B/6867024 dated 11.11.2025, issued by the Respondent. 2.

On 24.04.2026, the following order was passed: "1. Learned counsel representing the parties have been heard at some length.

2. In order to shorten further litigation, particularly since the Petitioner‟s bid has been rejected on a minor technical ground, this Court considers it appropriate to direct the Respondent to open the Petitioner‟s financial bid and prepare a comparative chart of the Petitioner vis-à-vis the other firms whose technical bids have already been evaluated. The said comparative chart shall be placed before this Court in a sealed cover on the next date of hearing. This direction is issued without prejudice to the rights and contentions of the parties.

Pursuant to the aforesaid direction, learned senior counsel representing the Respondent has produced an analysis of various bids received by the Respondent including that of the Petitioner, while assuming to have technically qualified.

Though this analysis has been done without prejudice to the claim of the Respondent, it has been disclosed that the total intake capacity is 990 tonnes per day („TPD‟), which is to be distributed according to the criteria laid down in the bid document. It is submitted that the Petitioner‟s name figures at serial No.31, whereas the bucket list of 990 TPD gets completed at serial No.21. 5.

Keeping in view the aforesaid position, no order is required to be passed in the present Writ Petition. Hence, the present Petition, along with pending application, is disposed of. 6.

Needless to observe that this Court has not gone into the question of territorial jurisdiction, in view of the subsequent developments.
