The appellant has challenged acquittal of respondent by way of judgment dated 14.10.2014 of the learned Magistrate. The acquittal of respondent in those proceedings under Section 138 Negotiable Instruments Act was mainly because the date of the cheque in question was prior to the date of the invoice, which showed that the cheque had been issued without any existing liability.

For past five six dates none has been appearing for appellant. Since none appears, the appeal is dismissed in default and for failure to prosecute.
