Counsel for the petitioner submits that after the petitioner's Contract was cancelled by the respondent/MCD, the same has already been allotted to a third party.

In view thereof, prayer (A) has become infructuous. 4.

Insofar as prayer (B) is concerned, counsel appearing for MCD submits that the aforesaid amount of Rs.16,41,800/- has been paid by the petitioner under protest.

In view of the aforesaid position, the petitioner may file an application for reconciliation before the MCD.

In the event such an application is filed, the MCD shall decide the same within three (3) weeks from the date of filing of the application. 7.

Accordingly, the writ petition along with pending application stands disposed of.
