Exemption allowed, subject to the condition that petitioner will file the duly sworn/attested affidavit and the requisite Court fee within 72 hours from the date of resumption of the regular functioning of this Court.

This writ petition is moved by petitioner for release of his eRickshaw bearing registration No.DL5E-R-9221 seized by the police officials on 11.05.2020, when at about 08.00AM the petitioner was returning from Maharaja Agrasan Hospital, along with his daughter after her dialysis. He was stopped by the police officials of police station Mahendera Park, who took away the keys of his e-Rickshaw and seized it on the ground the petitioner was driving e-Rickshaw during the lockdown period.

The learned counsel for petitioner alleged despite making written representation on 20.05.2020, the e-Rickshaw was never released by the police. However, the learned counsel for petitioner informs that on receipt of summons of this Court, the e-Rickshaw has since been released to the petitioner by the Investigating Officer, without making any further querries.

However, the learned ASC for the State on the other hand says the e-Rickshaw was released only after submission of the copy of the registration certificate by the petitioner to the Investigating Officer. 7.
Since, now the e-Rickshaw has been released to the petitioner, the petition has become infructuous. No further directions are called for in this petition.

The petition stands disposed of accordingly. No order as to costs.
