O R D E R

% 27.05.2016 Ms Asha, the complainant in the subject FIR, who is present in person in court today and has been identified by the IO in the subject FIR, states that she has amicably resolved the matrimonial differences which led to the registration of the same with her husband Vishal, who is the applicant herein. In pursuance to the aforesaid amicable settlement between the parties the latter have taken steps towards obtaining a decree of divorce by mutual consent on 13.05.2016. It is an admitted position that there is no financial consideration in the amicable resolution of the matrimonial dispute. The present application under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail in FIR No.638/2015 under Sections 498-A/406/34 IPC registered at Police Station- Sarai Rohilla, is allowed in the facts and circumstances afore-stated. Even otherwise it is observed that the applicant has clean antecedents.

Consequently, in the event of his arrest the applicant shall be released on bail on his furnishing personal bond in the sum of `5,000/- with one surety of the like amount to the satisfaction of the Arresting Officer/Station House

Incharge subject to the condition that he shall join investigation as and when called upon to do so by a police officer in accordance with law. The application is disposed of accordingly.
