O R D E R

CM APPL.47482/2025 (seeking permission to travel abroad from 09.08.2025 to 03.09.2025) 1.

The present application has been filed by the applicant/ petitioner seeking permission to travel to the United States of America (USA) between 09.08.2025 to 03.09.2025 for the purpose of visiting his daughter. 2.

It is submitted by learned counsel for the petitioner that vide judgment dated 24.05.2024 passed in W.P. (C) No. 7093/2022, this Court had quashed the Look Out Circular (LOC) issued against the petitioner. It is pointed out by the learned counsel for the petitioner that there is no stay granted by the Supreme Court against the judgment of this Court dated 24.05.2024. Nonetheless, the LOC continues to remain in force against the petitioner.

Learned counsel for the petitioner submits that the petitioner had earlier approached the Supreme Court by way of IA No. 170004/2025 in SLP (C) No. 26990/2024 seeking permission to travel abroad. However, the petitioner is stated to have been relegated to this Court. 5.

Learned counsel for the petitioner points out that on previous occasion/s, this Court has permitted the petitioner to travel abroad. Learned counsel for the petitioner, on instructions, undertakes that the petitioner shall strictly abide by the conditions that may be imposed by this Court. 6.

While opposing the present application, learned counsel for the respondents submit that in case the petitioner is granted permission to travel, the same be subject to the same conditions, as imposed by this Court on previous occasions.

In the above circumstances and considering the previous order this Court finds no impediment in allowing the petitioner to undertake the travel to USA, from 09.08.2025 to 03.09.2025, subject to the following terms and conditions :

(i) The petitioner shall file undertakings, both on his own behalf and on behalf of his wife, before the Registrar General of this Court, stating that the property bearing No. B-2/2227, Vasant Kunj, New The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Delhi-110070 shall not be alienated or disposed of during the petitioner's travel period. Copies of documents relevant to the said property shall be furnished before the Registrar General as also to the respondents.

(ii) The petitioner shall also file an undertaking before the Registrar General affirming that he shall return to India no later than 03.09.2025.

(iii) The petitioner shall furnish a copy of his air travel tickets, along with a detailed itinerary and details pertaining to his stay and address of stay, to the Registrar General.

(iv) The petitioner shall file an undertaking stating that he shall adhere to the itinerary furnished and not visit any other stations. (v) The petitioner shall submit to the Registrar General, the contact numbers which would be used by him during the period he stays abroad, with an undertaking that at least one of such numbers shall remain operational at all times, subject to all just exceptions including the period he is in the aircraft.

(vi) The petitioner shall intimate the respondent - Union of India/ concerned authorities prior to his departure and within 72 hours of his return from abroad.

(vii) The petitioner, upon his return to India, shall file a self attested copy of his passport along with a copy of his visa before the Court. (viii) The permission to travel abroad granted by this order shall be subject to other applicable conditions and shall not be deemed as a direction to any other authority.
