% 23.01.2017 Learned counsel for the applicant has submitted that on enquiry he has learnt that the plaintiff has certain assets which can be sold and part of the court fees can be arranged. It is further submitted that from the execution petition filed by the applicant, he is likely to get some money and will be able to pay court fees. It is submitted that on permission from his client, he seeks permission to withdraw the present application for declaring the plaintiff, an indigent person. In view of the submission, the application is dismissed as withdrawn. The suit/plaint is returned to the plaintiff for filing it with proper court fees.
