This suit is instituted by the Plaintiff seeking a decree of permanent injunction restraining the Defendant and all others acting on its behalf from manufacturing, selling, offering for sale, advertising and/or directly or indirectly dealing in any manner with tobacco-related products including but not limited to chewing tobacco bearing marks GOKUL/GOKUL DELUXE and/or any other trademark/trade name/domain name etc., deceptively similar to Plaintiffs registered trademarks GOPAL (both in English and Hindi) and its variants including but not limited to GOPAL DELUXE, GOPAL GRENE, amounting to infringement.

During the pendency of the suit, parties were referred to the Delhi High Court Mediation and Conciliation Centre vide order dated 17.09.2025, where they have amicably resolved their inter se disputes and a Settlement Agreement has been executed on 10.02.2026, incorporating the terms of CS(COMM) 290/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. settlement. Copy of the Settlement Agreement has been placed on record. 3.
Court has perused the terms of settlement and finds the same to be lawful. Accordingly, the suit is decreed in terms of the Settlement Agreement between the parties which shall form a part of the decree and terms thereof shall bind the parties thereto. 4.
Registry is directed to draw up the decree sheet. 5.
Suit is disposed of along with pending application. 6.
Plaintiff is held entitled to refund of entire court fees in accordance with Court Fees Act, 1870.
