O R D E R

% 11.06.2020 [Hearing held through videoconferencing] 1.

The petitioner has filed the present application seeking interim bail for a period of forty-five days in FIR bearing no. 97/2019 under Section 307 of the IPC and Sections 25/27/54/59 of the Arms Act registered with Police Station Mahendra Park.

The status report has been filed which indicates that the allegation against the petitioner is that he had shot and injured one Mr Yash on 08.03.2019. The petitioner had acted violently as he was agitated on account of holding of a wedding ceremony / procession on the street where he resides.

The status report indicates that the fire arm (revolver) used by the petitioner has been recovered. The matter is currently pending trial and last date of haring was fixed on 15.04.2020. The status report also indicates that the petitioner has no other involvement except in the present FIR. 4.

Considering the above, this Court considers it apposite to allow the

present application and grant interim bail to the petitioner for a period of forty-five days from the date of his release. 5.

The petitioner shall be released on his furnishing a personal bond in the sum of ₹25000/- to the satisfaction of the Jail Superintendent. This is also subject to the following further conditions: (a) That the petitioner shall not leave the National Capital Territory of Delhi;

(b) That he shall provide a contact number and ensure that he is reachable at all times;

(c) That he shall report to the concerned Local Police Station where he resides on Monday of every other week (that is, every alternate Monday);

(d) That the petitioner shall surrender on or before the period of forty-five days from the date of his release;

(e) That the petitioner shall not try and contact the victim or any of his family members either directly or indirectly. 6.

The application is allowed in the aforesaid terms. 7.

A copy of this order be communicated to the jail authorities electronically.
