The present application has been filed on behalf of defendant no.8/counter-claimant seeking judgment and decree passed on admission. 2.
Mr. Darpan Wadhwa, learned Sr. Counsel appearing on behalf of defendant no. 8 submits that the plaint of the plaintiff has already been rejected under Order VII Rule 11 CPC and the only matter pending for adjudication is the counter-claim of defendant no.8. On the other hand, Mr. Rajesh Yadav, learned Sr. Counsel appearing on behalf of plaintiff/non-applicant submits that against the judgment rejecting the plaint of the plaintiff, an appeal has been preferred by the plaintiff, in which the next date is 21.01.2026. He therefore, urges the Court to defer the matter after the said date.
