This petition has been filed praying for a direction to the respondent to allow the petitioner to have a video call with the children on daily basis.

The respondent, who appears in person, submits that the children are aged about 17 and 11 years and do not wish to interact with the petitioner. I have also had a brief interaction with the girl child who is aged about 17 years.

The respondent, who appears in person, further submits that the petitioner had not paid the interim maintenance awarded by the learned Family Court and there are dues of almost Rs.1.50 lacs owed by the petitioner.

The petitioner does not dispute that he has not paid the maintenance.

I had put to the petitioner if he would be willing to pay at least Rs.25,000/- for the present to the respondent especially as the welfare of the children is also to be kept in mind. He expresses his inability to do so. He submits that at present, he can only pay Rs.10,000/- and thereafter shall pay maintenance on monthly basis.

In my view, for passing any order in this present petition, the needs and rights of the parties and the children would have to be balanced. The petitioner cannot be allowed to claim only his rights and deny all his liabilities and responsibilities. I, therefore, find no merit in the present petition.

The petitioner shall be at liberty to approach the learned Family Court for seeking appropriate relief. The learned Family Court shall consider any such application filed by the petitioner remaining uninfluenced by the present order.
