After hearing arguments for some time, learned counsel for the petitioners submits that he may be permitted to withdraw the present petition while seeking liberty to deposit an amount of Rs.5 lacs with the learned Trial Court within four weeks from today. 2.

Respondents had filed a suit under Order XXXVII CPC and while hearing arguments on application seeking leave to defend, the defendants (petitioners herein) had been granted conditional leave to defend the above suit subject to their depositing FDR in a sum of Rs.5 lacs within eight weeks.

In view of the above statement made by the learned counsel for the petitioners, the present petition is dismissed as not pressed. However, the petitioners i.e. the defendants are granted four weeks' time from today to deposit the above said FDR before the learned Trial Court and also to file written statement, failing which, the CM(M) 2276/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
