By this petition the petitioner challenges the communication dated 12th January, 2018 rejecting the parole to the petitioner which the petitioner had sought on the ground that his wife is suffering and was required to undergo hysterectomy. The competent authority rejected grant of parole for the reason that six months period had not lapsed from the termination of the previous parole granted to the petitioner.

A perusal of the nominal roll reveals that the petitioner was granted parole for three weeks, w.e.f. 23rd March, 2017 by the Government of NCT of Delhi and parole of two weeks w.e.f 13th July, 2017 by this Court which was further extended till 17th August, 2017. Thereafter the petitioner has been granted furlough for a period of three weeks from 9th November, 2017 W.P.(CRL) 256/2018

and two weeks w.e.f. 9th December, 2017. Even in January, 2017 the petitioner was granted furlough for a period of two weeks. Thus the petitioner availed the benefit of parole/furlough for a period of 15 weeks in the year 2017.

Considering that the petitioner surrendered after last furlough only on 23rd December, 2017, this Court finds no ground to interfere in the order passed by the competent authority.

Petition is dismissed. Copy of the order be communicated to the petitioner through Superintendent, Mandoli Jail. 5.
