The present petition was filed challenging the order dated 05.05.2018 passed by the learned Additional Sessions Judge ('ASJ'), Dwarka District, Delhi whereby the petitioner is summoned in Complaint Case No.18/2018 filed by Respondent No.2 alleging commission of offences under Section 448 of the Companies Act, 2013 and Sections 469/471 of the Indian Penal Code, 1860.

The learned counsel for the petitioner submits that the parties have settled their disputes vide a Memorandum of Settlement dated 07.12.2024, executed between the parties. The learned counsel for the complainant/ Respondent No. 2 also submits that the parties have settled their disputes and that the complainant seeks to withdraw the complaint bearing CC No.18/2018, pending consideration before the learned ASJ. 4.

Both the learned counsels request that the pending complaint be quashed.

The Memorandum of Settlement dated 07.12.2024 executed between the parties has been filed alongwith CRL.M.A. 37837/2024. Perusal of the same indicates that the parties have resolved their disputes and hold no future claims against each other. The parties have entered into a settlement of their own free will, without any coercion, undue influence or threat. 6.

In view of the above, the present petition is allowed and the Complaint Case bearing CC No.18/2018 is quashed. However, the question of law is left open.
