Mr. Vikas Chopra, Stading Counsel appearing on behalf of the respondent/MCD, submits that in the event the petitioners file an application for temporary de-sealing before the respondent/MCD, along with an undertaking to demolish the unauthorised construction, the same shall be duly considered by MCD.

Accordingly, counsel appearing on behalf of the petitioner does not press the writ petition, while seeking liberty to approach MCD with an appropriate application for temporary de-sealing along with the requisite undertaking.

The writ petition is disposed of with the aforesaid liberty. 5.

In the event the petitioner files an application for temporary desealing, the same shall be considered expeditiously.
