On our request, Mr. Manu Chaturvedi, learned counsel representing MCD has accepted notice.

This Public Interest Litigation petition raises concerns about poor upkeep of the park as described in the writ petition. 4.

With regard to the nature of issues raised in this petition, we find it appropriate to permit the petitioner to take up his cause by way of making a representation before the Competent Authority of MCD taking all the pleas which may be available/permissible under law enclosing therewith all the documents which he intends to rely upon, which shall be attended to and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. decided by the competent authority.

Accordingly, without entering into the merit of the claim of the petitioner, we dispose of this writ petition with the following directions: (i) The petitioner shall make a representation for redressal of the grievances expressed in this writ petition to the Deputy Commissioner, Shahdara, South Zone, MCD within a fortnight from today.

(ii) Once any such representation is made, the same shall be attended to by the Competent Authority who shall take into account all relevant aspects and take a decision into the grievances which may be expressed by the petitioner in his representation. (iii) On consideration of the representation, if the Competent Authority finds it appropriate to take action which may be permissible under law for protection of the park, the said measure shall also be taken by the authority/authorities concerned.

(iv) The decision on the representation to be preferred under this order by the petitioner shall be made within four weeks from the date it is received by the Authority concerned. (v) The decision so taken shall be communicated to the petitioner forthwith.
