This petition has been filed praying for a direction to be passed to the learned Metropolitan Magistrate-10 South East District, Saket Courts, to dispose of the Protest Petition filed by the petitioner in Crl. Case No.1338/2017 titled State v. Untrace.

On FIR No.253 dated 29.05.2015 registered at Police Station: Pul Prahlad Pur under Sections 420/406/473/488 of the Indian Penal Code, 1860 (in short, 'IPC'), a closure report has been filed by the police, while the above Protest Petition thereagainst has been filed by the petitioner.

The learned counsel for the petitioner submits that the said Protest Petition has been pending adjudication since 2017. that it was finally heard on at least three occasions. However, orders were not pronounced.

On the other hand, the learned APP, on instructions from the Investigating Officer (IO), submits that almost for the last 1 year, it is the petitioner who, either himself or through a counsel, has not been appearing before the learned Trial Court.

Be that as it may, as the Protest Petition has been pending adjudication since 2017, that is, almost 7 years, the learned Trial Court is requested to adjudicate on the same expeditiously without granting any further adjournments to either party.

The learned counsel for the petitioner submits that the petitioner shall definitely be present before the learned Trial Court on the next date of hearing, which is fixed as 08.04.2024. 8.

The petition is disposed of in the above terms. 9.

A copy of this Order be sent to the learned Trial Court. 10.
