Petition under Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for quashing of FIR No. 0514/2023, under Sections 279/337 IPC, registered at PS: Fatehpur Beri and proceedings emanating therefrom.

Learned APP for the State and respondent No. 2 in person appear on advance notice and informs that matter is pending investigation. 3.

After partly making some submissions, learned counsel for petitioner seeks to withdraw the petition with liberty to file afresh after the chargesheet is filed.

Taking the statement of learned counsel for the petitioner on record, petition is accordingly dismissed as withdrawn, without prejudice to the rights and contentions of the petitioner and with liberty to file afresh after final report is filed by prosecution. Pending applications, if any, also stand disposed of.
