% 22.06.2020 Proceedings of the matter have been conducted through video conferencing.

This Public Interest Litigation has been preferred with the following prayers:

"(a) Issue a direction in nature of mandamus or any other appropriate writ, order/direction or directions thereby setting aside, cancelling the office order dated 02.06.2020 as issued by the respondent no. 3; and/or (b) Issue a direction in nature of mandamus or any other appropriate writ, order/direction or directions thereby directing the respondent to allow every patient/citizen to get COVID-19 test done whether the person is symptomatic patient or asymptomatic patient or presymptomatic patient; and/or c) pass any other further orders/directions in the interest of the human lives and for protection of the fundamental rights of the citizens of this country under articles 14, 19 and 21 of the constitution of India; and/or W.P.(C) No.3388/2020

d) Pass such further order(s) as may be deemed fit and proper under the facts and in the circumstances of the case." 2.

Having heard the petitioner in person and counsel for the respondents and looking to the facts and circumstances of the case and also to the status report filed by the Government of NCT of Delhi, it appears that the Hon'ble Lieutenant Governor, being Chairperson of the Delhi Disaster Management Authority, vide order dated 8th June, 2020, has already set aside the impugned office order dated 2nd June, 2020 and restored the testing strategy recommended by ICMR in NCT of Delhi. In view of this status report filed by the Government of NCT of Delhi and looking to the latest order issued by the Hon'ble Lieutenant Governor dated 8th June, 2020, we see no reason to pass further orders in this Public Interest Litigation. 3.

It is expected from the Government of NCT of Delhi that the directions issued by the Hon'ble Lieutenant Governor dated 8th June, 2020 shall be followed scrupulously.
