% 06.10.2025 CM APPL. 62684/2025 By way of the present application filed under Order XXIII Rule 3 read with section 151 of the Code of Civil Procedure 1908, the appellant/applicant seeks leave to withdraw the present appeal since the parties have amicably settled the matter under the aegis of the Delhi High Court Mediation & Conciliation Centre vide Settlement Agreement dated 06.09.2025, a copy of which has also been appended to the application.

Ms. Archana Yadav, learned counsel for respondent has joined the proceedings via video-conferencing; and confirms the position. 3.

In view of the above order passed in CM APPL. 62684/2025, the present appeal is disposed-of as withdrawn.

At this stage, learned counsel appearing for the appellant seeks refund of the entire court-fee.

However, in compliance of the provisions of section 16-A of the Court Fees Act 1860 (as applicable to Delhi), 50% of the court fee affixed on the memo of appeal is directed to be refunded to the appellant.

The Registry is directed to draw-up the requisite certificate in favour of the appellant for refund of half of the court fee, within 02 weeks of the appellant approaching the Registry for the purpose.
