Counsel for the Narcotics Control Bureau ('NCB') draws attention to the compliance affidavit filed by respondent no.1 and states that, as far as the private complaint of the petitioner regarding her husband's alleged drug abuse and, harassment and torture, is concerned, steps have been already taken, and an FIR No.592/2022 was registered under Sections 498A/406/34 of the Indian Penal Code, 1860. A chargesheet has been subsequently filed. 2.

As regards the role of the NCB, it is stated that it is a Nodal Agency mandated to take measures for implementation in respect of countermeasures against illicit traffic, and its role has been defined in that regard. It is stated that the scope of the mandate is primarily to provide coordination, take actions for combating illicit drug trade, and is specially mandated to dismantle International or Inter-State Drug Syndicates. An affidavit has been filed in this regard by the NCB in July 2023. 4.

Counsel for NCB states that they had made inquiries on the private complaint filed by petitioner and even at the hospital, through the colleagues, where Dr. Pranav Jain worked, and there was no situation that led to recovery of any contraband. Further, there are no criminal antecedents against Dr. Pranav Jain.

In this regard, he states that it appears to be a private complaint based on a private dispute, and in any event, is outside the remit of NCB. 6.

As regards the investigation, the investigating agency has already filed the chargesheet, which the competent Court shall consider. 7.

Accordingly, no further directions are required. 8.

Petition is disposed of noting the above observations. 9.

Needless to state, submission of counsel for NCB is not a determination of the guilt of Dr. Pranav Jain or otherwise of the merits of the matter, as far as the private complaint of the petitioner is concerned. 10.
