W.P.(C) 3394/2020 & C.M. APPL. 12048/2020 Present writ petition has been filed by the Teachers working in North Delhi Municipal Corporation Schools seeking a direction to the Respondents to release their salaries, which allegedly have not been paid since March, 2020.
Petitioners have candidly admitted in para 3 of the writ petition that the jurisdiction to adjudicate service matters of teachers working in North DMC lies with the Central Administrative Tribunal. However, on account of non- functioning of the Tribunal since March 2020, Petitioners have approached this Court.
The jurisdiction to entertain service matters with respect to the teachers of Schools of North Delhi Municipal Corporation lies with the Central Administrative Tribunal by virtue of Section 14(1) of Administrative Tribunals Act, 1985 and the judgment of the Constitutional Bench in L. Chandra Kumar vs. Union of India (1997) 3 SCC 261. This Court thus has no jurisdiction to entertain the present petition. In view of the above, petition is dismissed with liberty to the Petitioners to take recourse to the appropriate remedies available to them in law.
