Counsel appears for the defendants and submits that the defendants do not wish to contest the present suit and are willing to suffer a decree of permanent injunction.

Counsel for the defendants further submits on instructions that after 31st May, 2024, there has been no production of the impugned products by the defendants.

Mr. Saif Khan, counsel appearing on behalf of the plaintiff, submits that even though the listing of the impugned products on the social media platforms has been removed, the impugned products are still listed on the defendant's website. A copy of the aforesaid listing has been shared with the counsel for the defendants who assures the Court that the same shall be taken down immediately.

The defendants shall file an affidavit within one (1) week from today that they have removed the aforesaid listing of the impugned products from their website.

Accordingly, a decree of permanent injunction is passed in favour of the plaintiff and against the defendants in terms of payer clause contained in paragraph no.71(a), (b) and (c) of the plaint. 6.

Counsel for the plaintiff does not press for remaining prayers made in the plaint.

Decree sheet be drawn up accordingly.

Since the matter has been settled at an early stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870.
