The present bail application has been filed on behalf of the petitioner seeking interim bail in FIR No. 166/2015 under Sections 3 & 9 of Indian Official Secrets Act registered at Poice Station Crime Branch. 2.
Learned counsel for the petitioner submits that the petitioner's family is suffering on account of poor financial condition. It is further stated that the petitioner has three children and their school fees has not been paid. 3.
In terms of the last order, the Status Report has been placed on record. As per the Status Report, the petitioner is involved in an offence punishable under Sections 3 & 9 of Indian Official Secrets Act and has been in custody since 06.12.2015.

As per the Status Report, the wife of the petitioner was contacted telephonically, who informed that there has not been any credit of the salary for the past six months and the petitoner's ATM card is broken. BAIL APPL. 1167/2020

To the above submission, the Status Report mentioned as follows:- "During the course of inquiry it is revealed that account no. 20038939141 was found to be operated in the name of applicant accused and available balance is Rs.11968/-. Account statement of applicant accused shows that he is receiving his salary regularly and same is being withdrawn through ATM".

A Statement of account has also been annexed with the Status Report, which shows regular withdrawal from the said account. 7.
In view of the above, no ground to admit the petitioner on interim bail is made out.
