The present application has been filed on behalf of the petitioner seeking interim bail in FIR No.28/2018, registered under Sections 394/395/397/411/34 IPC at Police Station Moti Nagar, Delhi on the ground that the petitioner's father has to undergo prostatectomy on 17.06.2020. 2.

A status-cum-verification report has been placed on record by the State wherein it has been verified that the petitioner's father has to undergo prostatectomy on 17.06.2020 at N.C. Hospital situated at Sewak Park, Dwarka Mor, New Delhi. It has been stated that there is no one else in the petitioner's family except the petitioner to look after and take care of his ailing father. Although, it has been stated that the petitioner's uncles, who

are the residents of the same village, are available, however, learned counsel for the petitioner submits that as per the doctor's prescription, there may be requirement of blood at the time of the surgery. It has also been stated that the complainant of the case has already been examined and the other material witness of the case, namely, Naveen Jain, has not been appearing before the Trial Court since July, 2019. It has been stated in the status report that the petitioner is not involved in any other case. 3.

In view of the above, the petitioner is admitted to interim bail for a period of four weeks from the date of his release, on his furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty Magistrate and subject to the following further conditions:- (i) In case the surgery of the petitioner's father is not performed on 17.06.2020, the petitioner shall surrender on 18.06.2020 before the concerned Jail Superintendent. (ii) The petitioner will remain in touch with the IO/SI Banwari Lal on his mobile number- 8459963063 on every Monday during the period of his release on interim bail.

(iii) The petitioner will not leave the NCR without the prior permission of the concerned Court.

(iv) The petitioner will not directly or indirectly get in touch with the complainant or any other prosecution witness and shall not try to tamper with the prosecution evidence.

(v) At the expiry of the interim bail period, the petitioner shall surrender before the concerned Jail Superintendent.

The application stands disposed of in the above terms. 5.
