This is a writ petition filed under Articles 226 of the Constitution of India seeking the following prayers:- "i. Issue a Writ of Mandamus directing Respondent No. 1 (Indian Nursing Council) to forthwith appoint inspectors and conduct a comprehensive inspection of Dumka College of Nursing, Mauza Banskuli, Thana No. 25, Circle - Banskuli, Thana Tongra, District Dumka, Jharkhand, under Section 12 of the Indian Nursing Council Act, 1947;

ii. Issue a Writ of Mandamus directing Respondent No. 1 (Indian Nursing Council) to require Respondent Nos. 3, 4, 5 and 6 to furnish full and complete accounts, bank statements, admission records, fee registers, expenditure statements and all other relevant documents pertaining to Dumka College of Nursing and Bina Karuna Trust from their inception till date, in exercise of powers under Section 13 of the INC Act, 1947; iii. Issue a Writ of Mandamus directing Respondent No. 1 (Indian Nursing Council) to initiate proceedings under Section 14 of the Indian Nursing Council Act, 1947 for withdrawal of recognition granted to Dumka College of Nursing, in view of the financial misappropriation, fraudulent institutional management, and non-compliance with INC norms by Respondent Nos. 3, 4, 5 and 6; iv.

Direct the Respondent No.

(Jharkhand Nurses Registration Council) to independently inquire into the functioning, finances and compliance of Dumka College of Nursing with prescribed norms, and to take appropriate action including suspension or withdrawal of state-level affiliation/recognition;

v. Direct the Respondent Nos. 3, 4, 5 and 6 to produce before this Hon'ble Court, all accounts, bank statements, income-expenditure statements, admission records, fee receipts, construction accounts and all other documents of Dumka College of Nursing and Bina Karuna Trust from inception till date;

vi. Direct the Respondent Nos. 4, 5 and 6 to restore the Petitioner to his lawful position as Vice-President of Bina Karuna Trust and as joint authorized signatory on all Trust bank accounts, and to ensure no transaction is effected from the Trust's bank accounts without the Petitioner's signature; vii. Direct the Respondent No. 7 (Branch Manager, Union Bank of India, Dumka Branch) to: (i) immediately restore the Petitioner's registered mobile number for all transaction alerts on A/c No. 573901010050346 and any other Trust account; (ii) not permit any debit, withdrawal, transfer or encashment from A/c No. 573901010050346 or any other Trust/College account except under the joint signature of the Petitioner; and (iii) not allow opening of any new or parallel account in the name of the Trust or the Colleges without the Petitioner's written consent;

viii. Pending hearing and final disposal of this Writ Petition, pass an ad-interim order directing: (i) Respondent Nos. 3, 4, 5 and 6 to maintain status quo with respect to the assets, properties, bank accounts and financial operations of Dumka College of Nursing and Karuna Se Trust; (ii) Respondent No. 7 not to permit any debit transaction from A/c No. 573901010050346 except under joint signatures; and (iii) Respondent Nos. 4 and 5 not to alienate, transfer or encumber any movable or immovable asset of the Trust or the Colleges without prior permission of this Court; ix. Mr. Kumar, learned counsel for the petitioner, states that the petitioner would be satisfied if the respondent No. 1 considers the legal notice dated 02.12.2025 and pass a speaking order addressing the issues therein.

Ms. Nair, learned counsel for the respondent No.1 is agreeable to the said course of action.

For the said reasons, the present petition is disposed of directing the respondent No.1 to duly consider the legal notice dated 02.12.2025 and if the need so arises, call the involved parties for a personal hearing and pass a speaking order. The entire exercise shall be concluded expeditiously.
