This is a petition filed by the Petitioner-M/s. Shalimar Paints Ltd. under Section 29A of the Arbitration and Conciliation Act, 1996 (hereinafter, 'the Act') seeking extension of the mandate of the ld. Arbitral Tribunal. The Petitioner has invoked arbitration proceedings arising out of the Loss of Profit (Fire) Policy dated 1st April, 2016, issued by the Respondent-M/s. United India Insurance Co. Ltd. in favour of the Petitioner. The proceedings before the ld. Arbitral Tribunal are presently at the stage of Respondent's evidence. The present petition for extension of the mandate is stated to have been filed with the consent of the Respondent. 3.

Vide order dated 4th April, 2024, notice was issued in the present petition.

There is no appearance on behalf of the Respondent. On behalf of the Petitioner, it is pointed out that in the proceeding sheet before the ld. Arbitrator, dated 2nd March, 2024, it is recorded as under: "Extension of Time:

8. As the mandate of the Tribunal is expiring on 22.04.2024, the Claimant undertakes to file an application under Section 29A of the Arbitration and Conciliation Act, 1996 seeking extension till end of December 2024. Mr. Abhishek Gola, Ld. Counsel for the Respondent, fairly submitted that the Respondent has no objection and they will so express before the Hon'ble Court."

In view of the above, it is clear that the Respondent has consented to the extension of the mandate. Accordingly, the mandate of the ld. Arbitral Tribunal is extended by another period of eight months i.e., till 31st December, 2024.

The petition is disposed of. All pending applications are also disposed of.
