By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks following reliefs:- "a) Set aside the impugned order dated 28.03.2026 passed by the Ld. ASJ -02, West District, Tis Hazari Courts, Delhi in Criminal Appeal No. 139/2026, to the extent it directs the Petitioner to deposit a sum of RS. 20,00,000/- and permits unconditional issuance of Demand Draft in favour Respondent without any safeguard.

b) Exempt the Petitioner from depositing 20% of the compensation amount as contemplated under Section 148 of the Negotiable Instruments Act, 1881 during the pendency of the appeal OR Permit the Petitioner to deposit the admitted amount of Rs. 2,35,000/- before this Hon'ble Court within a period of 60 days from the date of the order, without prejudice to his rights and contentions in the appeal.

c) Direct that in the event any amount is deposited, the same shall not be released to the Respondent without adequate security to safeguard the interest of the Petitioner, subject to the outcome of the appeal;

d) Pass any other or further relief/ order(s), which this Hon'ble Court deem fit and proper in view of facts and circumstances of the case, in the interest of justice." 2.

After some arguments, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to seek appropriate remedy if as and when required in accordance with law.

Accordingly, the present petition, alongwith the pending applications, is dismissed as withdrawn with liberty as prayed for.
