Learned counsel for the Petitioner submits that the Petitioner was harassed when he had been summoned for investigation. This is disputed by Mr. Satish Aggarwala, appearing for the Customs Authority. He submits that Petitioner was summoned to join investigation, which is being conducted. He submits that as per his instructions, Petitioner did not co-operate in the investigation.

This is disputed by the learned counsel for the Petitioner, who submits that Petitioner had appeared twice and provided all support towards the investigation by answering all the questions raised and providing all the documents that were required.

Without prejudice, Mr. Aggarwala submits that as of now, Petitioner has not been summoned to join further investigation. He submits that as and when there is a need to summon the Petitioner to join investigation, appropriate summons shall be issued to the Petitioner. 4.

Learned counsel for Petitioner submits that if the Petitioner is summoned, Petitioner shall duly co-operate and appear pursuant to the said summons.

Without prejudice, learned counsel for the Petitioner seeks leave to withdraw the petition, reserving the right of the Petitioner to take appropriate remedies in law.

Petition is dismissed as withdrawn.
