The learned Additional Public Prosecutor for the State, at the outset, submits that investigation has already concluded and no cognizable offence has been found.

He submits that the cancellation report has already been filed before the concerned Court.

The present petition was filed seeking quashing of FIR No. 439/2006 under Sections 420/46/471/120B of the Indian Penal Code, 1860.

Considering that the investigation is already complete and the State has not found any cognizable offence, learned counsel for the petitioner seeks liberty to withdraw the present petition and file a petition afresh in case any grievance remains in future. 5.

The present petition is disposed of with liberty to the petitioner as afore-stated.
