The present Letters Patent Appeal assails the order dated 17th April, 2020, rendered by a learned Single Judge in Writ Petition (Civil) No.2971/2020 titled 'Ashwini Mehra, Resolution Professional vs. Indian Oil Corporation Ltd. and Ors.'.

Ms. Anindita Roychowdhury, learned counsel accepts notice on behalf of respondent No.1/Resolution Professional. Mr. Rajiv Nayar, learned Senior Counsel appearing on behalf of Resolution Professional, on instructions, states that they seek leave to withdraw the said Writ Petition (Civil) No.2971/2020, which is pending adjudication before learned Single Judge, with liberty to approach the NCLT in this behalf.

Leave and liberty granted.

Since the petition itself has been withdrawn, the present appeal instituted on behalf of the appellant/Indian Oil Corporation Limited (IOCL) is hereby rendered infructuous.

In view of the foregoing, the interim injunction granted by the learned Single Judge vide order dated 17.04.2020, also stands vacated. Mr. V.N. Koura, learned counsel appearing on behalf of the appellant/IOCL states, on instructions from the latter, that they shall not invoke the Bank Guarantees being BG No.6059IPEBG150085 dated 13.11.2015 issued by Respondent No.3, BG No. 0346415BG0000099 dated 13.11.2015 issued by Respondent No.4, BG No. 00070043715 dated 20.11.2015 issued by Respondent No.5, BG No.0410916BG1000146 dated 12.11.2015, BG No. 0410915FG1000153 dated 20.11.2015, BG No. 0410915FG1000155 dated 20.11.2015 and BG No. 0410915FG1000156 dated 20.11.2015, issued by Respondent No.2, which were the subject matter of the impugned order dated 17.04.2020, for a period of one week from today.
