The present petition filed as a Public Interest Litigation, lays a challenge to the order dated 17.05.2020, issued by the Ministry of Home Affairs, Government of India to the extent that it states that all orders issued by NEC under Section 10(2)(1) of the Disaster Management Act, 2005 shall cease to have effect from 18.05.2020. Besides the aforesaid relief, the petitioner has also sought other reliefs. 2.

At the outset, Dr. Gahlaut, learned counsel for the petitioner states on instructions that since the Supreme Court is already seized of the issue raised in the present petition, in Writ Petition (Civil) Diary No.10983/2020 entitled Ficus Pax Private Limited vs. Union of India and W.P.(C) 3451/2020 Page 1 of 2

Ors., he may be granted leave to withdraw the present petition while reserving the right of his client to approach the Supreme Court for appropriate relief.

Leave, as prayed for, is granted. The present petition is disposed of alongwith the pending applications. We may clarify that no observations have been made on the merits of the case set up by the petitioner while granting leave.
