O R D E R

By a separate order passed today in CCP(O) 113/2013, the statements of the plaintiff and the defendant No. 2 (respondent no. 1 and 2 in the contempt petition) have been recorded to the effect that they are ready and willing to relinquish their 20% undivided share each in the suit premises, in favour of the defendant No.1 herein (petitioner in the contempt petition), of their own free will and volition and without any undue influence or coercion from any quarters. The plaintiff and the defendant No.2 have also agreed to execute Relinquishment Deeds in respect of their respective 20% shares each in the suit premises in favour of the defendant No.1 within two weeks CS(OS) 181/2010 Page 1 of 2

from today, at his expense.

In view of the above development, with the consent of the parties, the defendant No.1 is declared to be the owner of the entire suit premises (60% undivided share in his own right and 20% undivided share each of the plaintiff and the defendant no.2, respectively).

Counsels for the parties jointly state that in view of the above order, nothing further survives for adjudication in the present suit, which may be disposed of.

Accordingly, the suit is decreed in terms of the above order, while leaving the parties to bear their own expenses. Decree Sheet be drawn accordingly.
