This is an application seeking passing of a compromise decree in accordance with the terms and conditions of the settlement agreement dated 25.05.2023 executed between the parties.

I have gone through the settlement and the same is legal and lawful. 3.

The agreement is signed by Mr. Dinesh Kumar Aggarwal, who is the plaintiff, Mr. Sharad Aggarwal, who is the defendant Nos. 2 and 4 and Managing Director of defendant No. 1 and is also signed by his wife Smt. Jyoti Aggarwal. The settlement agreement is also signed by Mr. Atul Garg who is defendant Nos. 3 and 5 and by his wife Ms. Mukta Garg who is not a party to the suit.

The application is supported by the affidavit of defendant Nos. 2 and 3.

The counsels representing the parties have the affidavits in their favour and are competent to make the statements. 6.

The parties have arrived at a settlement on 25.05.2023. However, there were some disputes with regard to working of the settlement. Mr. Barki, learned advocate who was present in Court was requested to mediate in the matter.

With the assistance of Mr. Barki, issues have been clarified and now the counsels for the parties on behalf of the parties state that they will remain bound by the terms of the compromise.

For the said reasons, the instant suit along with pending application(s) is decreed in terms of the settlement. Parties shall remain bound by their obligations contained in the settlement.

The plaintiff is entitled to refund of the Court fees in view of Section 16 of the Court Fees Act, 1870. The Registry is directed to issue certificate for refund of Court fees.
