% 28.02.2024 Further to what was recorded in last order dated 12.02.2024, Mr. Pranav Rajput, learned counsel appearing for the petitioner seeks leave to withdraw the present petition, with liberty to approach the Supreme Court for seeking appointment of an arbitrator since the proceedings appear to be an 'international commercial arbitration' within the meaning of section 2(1)(f) of the Arbitration & Conciliation Act, 1996. The petition is accordingly disposed-of as withdrawn, with liberty as prayed for.
Pending applications, if any, also disposed-of. Mr. Rajput submits that in compliance of order dated 01.09.2023, the petitioner had filed in this court the original agreement from which the disputes are stated to have arisen. He requests that the original agreement be ARB.P. 522/2023 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. returned to the petitioner.
The record shows that the original agreement, viz. Product Supply TriParty Agreement dated 02.02.2019, has been filed in court.
