The challenge in the present petition is to the grant of unconditional leave to defend granted to the respondents in the suit filed under Order XXXVII CPC by the petitioner.

The learned counsel for petitioner submits that since, thereafter, the plaint has been ordered to be returned under Order VII Rule 10 CPC vide order dated 22.01.2025. Copy of the said order has been produced by the learned counsel for respondent. The same is taken on record. 3.

Since the plaint has already been ordered to be returned, the present petition along with the pending applications has become infructuous and are disposed of accordingly.
