W.P.(C) 3641/2019 & CM. No. 16655/2019 (for Stay) The challenge in this petition is to the show-cause notices dated November 3, 2018 and February 1, 2019 with regard to declaring the petitioners as wilful defaulters. Mr. Kuljeet Rawal, learned counsel appearing for the petitioners states that the show-cause notice is without giving the petitioners relevant documents / evidence relied upon by the authority concerned. He states, that it is precisely for that reason the petitioner has made Prayer (c) in the writ petition.

Ms. Shruti Vats, learned counsel appearing for the respondents states, if such a request is made, respondents shall consider the same and act in accordance with law. Noting the said submission and the fact that the present petition has been filed only against show-cause notices, this court is of the view that the present petition is premature. Liberty is with the petitioners to seek such documents as they want to rely upon in reply to the show-cause notices and it is for the respondents to consider such a request in accordance with law.

In view of the above, the petition stands disposed of. CM. No. 16655/2019 (for Stay) Dismissed as infructuous.
