% 21.02.2017 By this petition, the petitioner seeks modification of the order dated 28th September, 2016 passed by learned Additional Sessions Judge granting him bail subject to his furnishing personal bond in the sum of ₹30,000/- with one surety of the like amount.
Learned counsel for the petitioner submits that since the pecuniary position of the family of the petitioner is not got, he is unable to furnish personal and surety bonds and the same be reduced. Status report has been filed as per which the family of the petitioner lives at RZ-75, Indra Park, Uttam Nagar, New Delhi on a monthly rent of ₹6500/-. However father of the petitioner, who was an auto driver, expired recently. The petitioner has two married sisters who are now visiting and supporting the mother of the petitioner.
Considering the fact that the petitioner has roots in the society and has
mother and sisters in the family, this Court deems it fit to reduce the amount of surety bond as directed by the learned Additional Sessions Judge. Consequently, the order passed by the learned Additional Sessions Judge/Special Judge, NDPS Act dated 28th September, 2016 is modified and the petitioner be now released on bail on his furnishing personal bond in the sum of ₹30,000/- with one surety of ₹10,000/- to the satisfaction of learned Metropolitan Magistrate/Duty Magistrate with further condition that he will not misuse the liberty of bail in any manner and will maintain distance from the complainant and other prosecution witnesses as directed by the learned Additional Sessions Judge.
Petition is disposed of.
Order be communicated to the petitioner thorugh Superintendent, Tihar Jail.
