The present petition is filed seeking quashing of the complaint bearing CC No.404/2016 filed by the respondent under Section 138 of the Negotiable Instruments Act, 1881. The complaint was filed against the petitioners and three more accused persons.

After some arguments, the learned counsel for the parties are ad idem that the proceedings against Petitioner No.3 can be dropped and the matter shall proceed against other accused persons. The learned counsel for the parties agrees that Petitioner No.3 cannot be held liable for the offence.

In view of the above, the order dated 08.02.2016 is quashed qua Petitioner No.3.
