The learned counsel appearing for the appellant states that the disputes between the parties are settled and the terms of the settlement have been taken on record by the learned Commercial Court in CS(COMM) No.124/2023 captioned Hugo Boss Trade Mark Management GmbH & Co. KG v. Swish Boss Apparels Pvt. Ltd.

He further submits that in view of the aforesaid, the present appeal does not survive and seeks permission to withdraw the same. 3.

The appeal is accordingly dismissed as withdrawn. All pending applications are also dismissed.
