W.P.(CRL.) 903/2020 Issue notice. Mr. Mehra accepts notice on behalf of the State and Mr. Digpaul accepts notice on behalf of the Union of India. The status report filed by the State has been forwarded through what's app. Mr. Mehra states that as per the records of the Delhi Police, no case has been registered against the petitioner. Mr. Digpaul, who appears for the
Union of India, states that no case has been registered against the petitioner by any Central Investigation Agency. As per the status report, the statement of the petitioner was recorded on 28.05.2020, wherein he stated that it seems to him that MHA has ordered his house arrest. However, this position is not substantiated by any order. The statement of the brother of the petitioner has also been recorded and the brother has stated that the physical and mental condition of the petitioner Ashok has been deteriorating continuously since the last one and a half year. The brother has stated that the petitioner has not been put to any house arrest by the Government, but the petitioner entertains fears due to unknown reasons. The petitioner's brother Prakash has also stated that his family has also tried to get the petitioner admitted in mental hospital to get treatment, but that he could not be admitted. The statement of the petitioner, and his brother have also been annexed with the Status report.
In view of the aforesaid, no ground is made up for issuance of the writ as prayed for. At the same time, it appears to the Court the petitioner's mental and psychological condition needs attention. In case, the petitioner's brother approaches the I.O. concerned, he may provide whatever assistance is possible for petitioner's examination and treatment at IHBAS.
