Heard the learned Counsel for the Parties.

After arguing at some length, the learned Counsel for the Appellant states that the Appellant may be permitted to withdraw the present Appeal with the liberty to press all the pleas, which may be available to him before the learned Single Judge, where the writ petition is to be decided afresh. 3.
Accordingly, the present Appeal is dismissed as withdrawn with the liberty as prayed for.

It is needless to observe that once the earlier order has been recalled by the learned Single Judge while allowing the review petition, it will be open to both the Parties to take all the issues and pleas, which may be available to them under law, while the writ petition is heard afresh.
