The petitioner has filed the present petition, inter alia, aggrieved by the provision of issuing a public notice of 30 days for inviting objections for registration of marriages under the Special Marriage Act, 1954. The petitioner has, accordingly, prayed that the said procedure be struck down.

It is seen that the said procedure is prescribed under Section 16 of the Special Marriage Act, 1954 and, therefore, the petitioner seeks to

challenge the validity of the provisions of the said Statute, although the relief sought is not articulated in that manner. 5.

The learned counsel appearing for the petitioner seeks to withdraw the present petition with liberty to specifically challenge the statutory provisions prescribing the said notice.
